AHMAD OLAREWAJU BELGORE, J.C.A. (Delivering the Leading Judgment): This matter commenced at the Federal High Court, Abuja by an Originating Summons taken out by the Plaintiff (Now, The 1st Respondent) against three defendants, the Appellant herein being the 3rd defendant. Before the Federal High Court, Abuja (Now the The Trial Court), and four issues were posed for its determination, Viz:

i. Whether the Chief Registrar of the Federal High Court (1st Defendant) and the Union Bank of Nigeria Plc. (2nd Defendant) are obliged jointly and severally to account to SLB Consortium Ltd (The Plaintiff) alone or to the Plaintiff and the 3rd Defendant jointly for the USD$7,155,053.00 plus all the accrued interests which they hold on their behalf.

ii. Whether the 2nd Defendant is entitled to deduct sums due to it as well as any other creditor(s) of the Plaintiff or its Chairman towards the satisfaction of the indebtedness of the Plaintiff and or its Chairman, Dr. Akinola Ogunlewe on account of guaran…
