RULING

ASUMAN-ADU, J.

On 9th March, 2009 the plaintiff hearin, Abigail Vormawah, former sergeant in the Ghana Prisons Service issued out writ of summons against the defendants for the following reliefs:

a. A declaration that since the Minister for Interior has not complied with Section 19(3) of NRCD 46 of 1972, the service enquiry held at Wa Central Prisons in which the plaintiff was found guilty and later dismissed is null and void and of no legal effect whatsoever.

b. General damages for wrongful dismissal and

c. An order of the court directing the defendants to pay all benefits due to the plaintiff forthwith.

In the accompanying Statement of Claim, the plaintiff avers that on 22nd June, 2005, she was invited by the Regional Commander of Wa Central Prisons where she was informed that a prisoner had made an allegation against her, so she was made to submit a statement to the Regional Commander to that effect. She was later charged with three offences under Section 16(K) of NRCD 46 of 1972.…
