MOHAMMED MUSTAPHA, J.C.A. (Delivering the Leading Judgment): This appeal is against the Judgment of the Federal High Court, Abuja; Coram Hon. Justice A. Abdu-Kafarati, delivered on 18th day of October, 2010 in Suit No: FHC/ABJ/620/2008.
The Plaintiff/Appellants commenced this Suit by a Writ of Summons dated 5th day of November, 2008 and claimed against the Defendants/Respondents the sum of N115, 927,284.53 (One Hundred and Fifteen Million, Nine Hundred and Twenty Seven Thousand, Two Hundred and Eighty Four Naira Fifty Three Kobo); being the amount acknowledged by the Respondents as compensation due for the compulsory acquisition for public purpose from the Appellants.
The Defendants/Respondents entered appearance and subsequently filed an application challenging the jurisdiction of the trial Court to entertain the suit of the Plaintiffs on the ground that it is a land matter which ought to be tried in the state or Federal Capital Territory High Court.
