ADEREMI, JCA (Delivering the Lead Ruling): By the application dated and filed on 9th November, 2001 the applicants are praying this court to restrain Mr. Johnson Odion Esezoobo counsel for the respondent to desist from further representing him in this case.

In moving the application, Mr. Adetunji Oyeyipo referred to and relied in the affidavit particularly paragraphs 4 to 6. His (Esezoobo) appearance in the case amounts to professional misconduct as he was in the Legal Department of the 1st applicant as an employee; he prayed in aid of his submissions Rule 10(b) of the Rules of Professional Conduct of the Nigerian

He urged that the application be granted while contending that the counter-affidavit is a collection of opinions and should not be accorded any recognition.
