CHIDI NWAOMA UWA, J.C.A. (Delivering the Leading Judgment): The Federal High Court presided over by O. E. Abang, J. on the 30th May, 2014 in its Ruling dismissed the appellants application for leave to further amend its 1st Amended Statement of Defence.
The amendments sought to be introduced by the Appellants application were highlighted and underlined in the Proposed Amended statement of Defence at pages 168 - 172 of the printed records of appeal. The appellant made out that the facts in support of the Appellants application are uncontested as the respondent did not file any counter Affidavit in opposition.
