OGAKWU JCA (Delivering the Lead Judgment): On 31 July 2012, the appellant herein was convicted by the High Court of Edo State in Charge No. HUB/3C/2009, for the offences of conspiracy to commit murder and murder said to have been committed on or about 5 January 2008. The lower court, coram: Okungbowa J., sentenced the appellant to a term of ten years imprisonment for the count of conspiracy and to death by hanging for the count of murder. This judgment is in respect of the appeal lodged against the said decision of the lower court. The judgment of the lower court is at pages 74 - 111 of the records of appeal.The original notice of appeal which was filed on 4 October 2012 is at pages 112 - 119 of the records.
