MASSOUD ABDULRAHMAN OREDOLA, J.C.A.(Delivering the Leading Judgment): This is an appeal against the judgment of the High Court of Imo State sitting at Nkwerre (hereinafter referred to as the lower Court) delivered on the 2nd day of December, 2013. Coram: Hon. Justice T. E. Chukwuemeka-Chikeka, J.

The claimant/respondent (hereinafter referred to as the respondent) took out this action against the defendant/appellant (hereinafter referred to as the appellant), wherein he sought for the following reliefs:

1. A Declaration that the Plaintiffs are entitled to the Statutory Right of Occupancy over the piece or parcel of land known as and called Ala Isiobi situate at Umudurunnoko, Umunachi Nkwerre and verged RED in Plan No. ASA/IMDII/99 filed along with the statement of claim.

2. The sum of N10,000.00 being general damages for trespass.

3. Perpetual injunction restraining the defendants by themselves or through their servants, agents and privies from committing further acts of trespass over the …
