ADAMU JAURO, J.S.C. (Delivering the Leading Judgment): The instant appeal is against the judgment of the Court of Appeal, Abuja Division wherein the Court allowed the Respondent's appeal and set aside the ruling of the trial Federal High Court, Abuja Division, which had earlier dismissed the Respondent's action for want of jurisdiction. The Court below thus remitted the case to the trial Court for a fresh determination by another Judge.
SYNOPSIS OF FACTS
The Respondent was an employee of the Appellant. He was however dismissed from the service of the Appellant by a letter dated 6th January, 1999. As a result, the Respondent took out a Writ of Summons and a Statement of Claim to challenge his dismissal. During the pendency of the case, the Respondent was issued another letter by the Appellant, dated 26th April, 1999 (Exhibit A) purporting to dismiss him with effect from 30th April, 1999.
