<p><strong>SAULAWA, J.C.A. (Delivering the Leading Judgment):</strong> This is an appeal against the decision of the Federal High Court, Port Harcourt Judicial Division holden at Port Harcourt in suit No. FHC/PH/CS/554/2002, dated the 21st day of July, 2004, coram R.O. Nwodo, J.
