LATEEF ADEBAYO GANIYU, J.C.A. (Delivering the Lead Judgment): This appeal emanated from the judgment of Edo State High Court of Justice, sitting in Benin City delivered on 12th July, 2018 Coram: J.U. OYOMIRE J (hereinafter referred to as “ the TRIAL COURT”) wherein the trial Court found the Appellant guilty as charged and convicted him accordingly but having regard to the fact that the Appellant was under 17 years when he committed the offence, the trial Court ordered that the Appellant be detained during the pleasure of the Governor of Edo State in accordance with the provisions of part 44 of the Criminal Procedure Law.

Being displeased with the said decision, the Appellant appealed to this Court vide his Notice of Appeal filed on 12/7/2018 which is reproduced at page 135 to 137 of the record setting out three Grounds of Appeal.

BRIEF STATEMENT OF FACT

The Appellant was arraigned before the trial Court for a sole count offence of murder, as stated hereunder.
