Judgement

SALAMI, JCA (Delivering the Lead Judgment): The plaintiff caused to be issued a writ of summons indorsed with eleven reliefs, with the last three being alternative claims to the first eight. Pleadings filed and exchanged were settled as the amended statement of claim and statement of defence. The claims of the plaintiff, which eventually went to trial, are as adumbrated in paragraph 30 of the amended statement of claim, which are set out immediately hereunder:- 30.

“Whereof the plaintiff claims against the defendants as follows-

(a) A declaration that the purported termination of his employment is wrongful, null and void and of no effect.

(b) An order of court reinstating the plaintiff to his former position as a deputy sales manager.

(c) An order directing the defendants to pay the plaintiff all his arrears of salaries, benefits and allowances from 30th June, 1993 until judgment.
