ITA GEORGE MBABA, J.C.A. (Delivering the Leading Judgment): This appeal is against the judgment of Abia State High Court in Suit No. HIN/M55/2008, delivered on 7/12/2010 by Hon. Justice C.I. Jombo-Ofo J., (as she then was) wherein the learned trial Judge awarded the sum of Eighty Thousand Naira (N80,000.00) as general damage to the Applicant (1st Respondent herein) as damages for violation of his fundamental rights, against the Appellant and the 2nd to 4th Respondents, who were all Respondents at the trial Court.

The 1st Respondent had filed a fundamental rights action against the Respondents (now Appellant and 2nd to 4th Respondents) for unlawful breach of his fundamental rights, seeking:

(a) A declaration that the arrest and detention of the Applicant on 17/6/08 to 24th June, 2008 at the Commissioner of Police Office, when he came for a conference after being bailed on the 4th day of June 2008 at the behest of the 1st Respondent on the instructions of 2nd, 3rd and 4th Respondents and …
