PAUL OBI ELECHI, J.C.A. (Delivering the Leading Judgment): This is an appeal in suit No. N/41/2008 against the decision/Ruling made on the 17th day of March 2010 by Honourable Justice Kingsley N. Udeh (as he then was) sitting at the Nsukka High Court dismissing the Appellants motion on notice dated 4th March 2009 by Honourable Justice Romanus Odugu sitting at Nsukka High Court. Being dissatisfied with the Ruling, the Appellants filed their notice and grounds of appeal dated the 26th March 2010 to this Court challenging the ruling on several grounds.

The facts leading to this appeal is that on the 29/3/1974, the respondents obtained judgment in suit No. E/54/67 between Eze Nweleje and Charles Ezeugwu (for themselves and on behalf of the people of Amaogbo Nsukka V. Ugwuoke Nwangwu and Anor (for themselves and on behalf of the people of Oha Ihe Owerre (Appellants) in respect of a parcel of land known and called OGU AMAOGBO in which judgment was delivered by Honourable Justice Abai Ikweche…
