FREDERICK OZIAKPONO OHO, J.C.A. (Delivering the Leading Judgment): This is an appeal against the Judgment of the High Court of Anambra State of Nigeria, sitting at Nnewi and delivered on the 8-6-2010 in Suit No. HN/MISC/172/2009, wherein the Court below entered judgment in favour of the Applicant, who is now Respondent in this Appeal. By a Motion on Notice dated and filed on the 9-4-2009 the Respondent as Applicant claimed against the Appellants as Respondents the following reliefs:
1. An Order of the Honorable Court that the invasion of the Applicant's apartment or home at No. 27 Okija Street Okpuno-Egbu Umudim Nnewi on 19th February, 2009 at about 12 midnight by the 2nd and 3rd Respondents on the instigation of the 1st Respondent is unlawful and contrary to the Applicant's right to private and family life as guaranteed under Section 37 of the 1999 Constitution of the Federal Republic of Nigeria.
