Judgement

BELLO, CJN (Delivering the Leading Judgment): A very far-reaching constitutional question has been raised in this appeal. It is: Having stayed in prison confinement under a sentence of death for such an unreasonable length of time, from 28th February 1986 to date, it would amount to inhuman and degrading treatment contrary to Section 31(1) (a) of the Constitution of the Federal Republic of Nigeria. 1979 to uphold and execute the sentence of death passed on the 3rd Appellant.

The facts relevant to the question may be summarised. The 3rd appellant with four other persons were convicted of conspiracy to commit armed robbery and of armed robbery and sentenced to death on 28th February 1986. His appeal and the appeals of the three others were dismissed by the Court of Appeal on 29th March 1990. Further appeals to this court were filed on 26th April 1990.
