THERESA NGOLIKA ORJI-ABADUA, J.C.A.(Delivering the leading judgment)The criminal proceedings that germinated this appeal commenced at the Chief Magistrate Court of Ekiti State, sitting at Ado Ekiti, whereat the Appellant was arraigned on a two Count Charge of conspiring with others at large between 2015 and 2013(sic) at Ipoti-Ekiti within Ijero Magisterial District to commit felony to wit: Stealing and thereby committed an offence punishable under section 516 of the Criminal Code Law, Cap. C16, Laws of Ekiti State of Nigeria, 2012.
