RIDWAN MAIWADA ABDULLAHI, J.C.A. (Delivering the Leading Judgment): This appeal is against the judgment of Learned Justice F.O. Aguda-Taiwa, (PCCA): E.A Alade and Akinyemi Michael Owoyemi of the Ondo State Customary Court of Appeal, delivered on 6th day of August, 2015, confirming the judgment of the Customary Court, Ilutitun. The Appellants as plaintiffs commenced the action that culminated in this further appeal vide a claim dated 18/1/2005 claiming the following reliefs:
1. A Declaration that the Plaintiffs are the persons entitled to be issued certificate of Customary Right of Occupancy in respect of a parcel of land situate and being at Gborogho farmland in Iju-Odo in Okitipupa Local Government of Ondo State of Nigeria.
2. A Declaration that the Defendants have forfeited their right to farm on the land granted them by the plaintiffs, the Defendants having denied the Plaintiffs' right of ownership of the said land in dispute.
