Judgement

DENTON-WEST JCA (Delivering the Lead Judgment): The plaintiffs (hereinafter called the respondents), commenced an action against the defendant (hereinafter called the appellant), at the High Court of Ondo State sitting at Ondo Judicial Division, Ondo State, vide a writ of summons issued on 30 August 2007 and an amended statement of claim dated 26 April 2010 and filed on 27 April 2010. Therein, the plaintiffs claimed against the defendant as follows: Whereof the plaintiffs claims against the defendant, the sum of N10,000.000.00 (ten million naira only), being special and general damages suffered by the plaintiffs when the defendant actuated by malice and in the absence of reasonable and probable cause in March 2003 at Enuowa police station, Ondo, Ondo State, a place within the jurisdiction of this honourablecourt, lodged a complaints which were false to the knowledge of the defendant against the plaintiffs and subsequently procured the police to prosecute the plaintiffs in charge N…
