MOORE ASEIMO ABRAHAM ADUMEIN, JSC (DELIVERING THE LEADING JUDGMENT): The appellant was arraigned before the High Court of Delta State, holden at Agbor, and charged with the following offences:

“STATEMENT OF OFFENCE: COUNT 1

Conspiracy to commit armed robbery, punishable under section 1 (2) (a) of the Robbery and Firearms (Special Provisions Act Cap. 398 Vol. 22 Laws of the Federation of Nigeria 1990.

PARTICULARS OF OFFENCE

lsioma Okejere (m) on or about the 20th day of December, 2005 along lgbogiri Road lgbogiri within the Agbor Judicial Division conspired with others now at large to commit armed robbery.

STATEMENT OF OFFENCE: COUNT 2

Armed Robbery punishable under section 1 (2) (a) of the Robbery and Firearms (Special Provisions) Act Cap 398 Vol. 22 Laws of the Federation of Nigeria 1990.

PARTICULARS OF OFFENCE

lsioma Okejere (m) on or about the 20th day of December, 2005 along lgbogiri road, lgbogiri within the Agbor Judicial Division robbed one Roseline Katakpo (f) of the sum of N34,000.00…
