JIMI OLUKAYODE BADA, J.C.A.(Delivering the Leading Judgment): This appeal emanated from the Judgment of Delta State High Court of Justice, Asaba, in Charge No: A/55C/2014 THE STATE V. EMEKA OKEZE,delivered on the 31st day of January, 2017 wherein the Appellant was found guilty and convicted for the offences of Conspiracy to commit Armed Robbery, Armed Robbery, Kidnapping and Assault. He was sentenced to death by hanging for the offences of conspiracy to commit Armed Robbery, Armed Robbery and Kidnapping and one year imprisonment for Assault.

Briefly, the facts that led to this Judgment being appealed against are that the Appellant was charged with the offences of conspiracy to commit Armed Robbery, Armed Robbery, Kidnapping and Assault.

The Appellant pleaded not guilty to the charge and the case went on trial. The Prosecution in proof of the case against the Appellant called two witnesses while the Appellant gave evidence in support of his case and he did not call any witness.
