TINE TUR J (Delivering the Lead Judgment): The Peoples’Democratic Party (1st defendant) fixed 23 November 2007 as a day for her primaries to select candidates for elections into the offices of Councillor and Chairman, to be conducted by the Benue State Independent Electoral Commission (BSIEC) (hereinafter called 7th defendant”) on 29 December 2007. Meanwhile, interested party candidates were given the opportunity to buy the necessary party forms to be screened at Nanet Hotels Ltd Makurdi on 18 November 2007. The plaintiff’s case is that he attended the screening exercise with his relevant documents and was duly cleared by the Committee to contest the primaries of the elections but the defendants did not release/issue clearance certificates to him or any of the candidates who attended the screening exercise. After the screening, the plaintiff went into extensive campaigns to enable him win at the primaries to represent the 1st defendant in the forthcoming election on 29 December 2…
