IKYEGH JCA (Delivering the Lead Judgment): The appellant was tried, convicted and sentenced to death by hanging by the High Court of Justice of Lagos State (the court below) for the offences of conspiracy to commit armed robbery and armed robbery contrary to sections 403A and 402(2)(a), respectively, of the Criminal Code Cap. C17, Vol.2, Laws of Lagos State. The facts from the respondent were put nutshell, that on 7 July 2010, the appellant in company of another person at large, robbed the PW2, a University student at the material time of his bag containing N20,000 (twenty thousand naira) at gun point at Jibowu bus stop. The person at large produced a gun with which he threatened PW2 before the robbery. Immediately after the robbery, the appellant carrying the person at large on a motor cycle, rode towards Anthony Village. The PW2 engaged a motorcyclist.
