Judgement

PAUL OBI ELECHI, J.C.A. (Delivering the Leading Judgment): This is an appeal against the judgment of the High Court of Anambra State, Onitsha Judicial Division Holden at Onitsha delivered by His Lordship, Honourable Justice J.I. Nweze on the 22nd day of December 2008 in suit No. 0/200/2006. In the said suit, the trial Court granted the Respondents claim and dismissed the counter-claim of the Appellant. Being dissatisfied with the said judgment, the Appellant has now lodged this appeal.

STATEMENT OF FACTS.

The Respondent at the lower Court filed a suit and claimed as follows;

(a) A declaration that the plaintiff by virtue of the Deed of Assignment dated 1st day of December, 2004 executed between the plaintiff and Benorac and Company (Nig) Ltd acting and exercising powers conferred on her as the donee of the irrevocable power of Attorney registered as No 96 at page 96 in volume 27 of the Land Registry in the office at Awka, executed in her favour by the defendant by virtue of the deed of G…
