Judgement

MUHAMMAD, JCA (Delivering the Lead Judgment): This is an interlocutory appeal, the decision of Hon. Justice J. O. Egbuna of the Awka Judicial Division of the Anambra State High Court dated 20th January, 1998.

The simple and straightforeword facts of the case which brought about the appeal shall be retold hereunder.

The 2nd-7th respondents in this appeal had as plaintiffs for themselves and on behalf of the Umuriam Obunese village Nawfia except Engineer A.E. Meniru, the 1st defendant, sued the appellants who were 2nd, 3rd and 4th defendants in the lower court. These defendants were sued for themselves and on behalf of the executive committee of Nawfia progressive Union. The plaintiffs hereinafter called respondents had in suit No. A/177/95 prayed the court against the 2nd, 3rd and 4th defendants, hereinafter referred to as appellants, for certain declaratory and injuctive reliefs.
