(Delivering the Leading Judgment): The Appellant; as the plaintiff before the High Court of Anambra State [trial Court] claimed against the Respondents [Defendants at the trial Court] vide a writ of summons and statement of claim dated the 24th day of September, 2008 and filed on the 14th day of October, 2008 as follows:-

(a) A Declaration that the retirement of the Plaintiff as Deputy Director (Accounts) in Anambra State Civil Service effective from 4/6/2001 is premature, unlawful, null, void and unconstitutional;
