TINUADE AKOMOLAFE-WILSON, JCA (Delivering the Leading Judgment): The appellant as Plaintiff, by her writ of summons filed on 18th February, 2010 and Further Amended Statement of claim filed on 9th November, 2010 claimed against the defendants jointly and severally as follows:

1. The sum of ₦5,060,00.00 (Five Million Sixty Thousand Naira) only being money payable by the defendants to the plaintiff for money lent by the plaintiff to the defendant at their request and interest thereon at the rate of 17% per month from 15th April, 2009 which the defendants agreed to pay the plaintiff.

PARTICULARS

1. March, 2008 - Amount lent ₦2,000,000.00 accrued interest of 17% per month agreed from 15th April, 2009 to 15th January 2009

=₦4,700,000.00

Total = ₦5,060,000.00

2. The plaintiff further claimed interest on the amount of the said loan at the rate aforesaid from 15/2/2010 until payment on judgment and 10% interest thereafter until the judgment debt is liquidated.
