RHODES-VIVOUR JCA (Delivering the Lead Ruling): By way of motion on notice brought under Order 7, rules 1 and 10(1) of the Court of Appeal Rules, 2007 and under the inherent jurisdiction of this court, the appellants/applicants seek the following:

1. An order for extension of time within which to file an application for an order to stay proceedings in suit No. ID/ 418M/04 pending the hearing and determination of the appeal filed against the ruling of the High Court of Lagos State, Ikeja delivered on 14 June 2007.

2. An order staying further proceedings in the suit No. ID/418M/04 pending the hearing and determination of the appeal filed against the ruling of the High Court of Lagos State, Ikeja delivered on 14 June 2007.

3. An order deeming the application for stay of proceedings as having been properly filed and served.

The application is supported by a 19 paragraphed affidavit deposed to by Ekene Maduegwuna Esq. a legal practitioner in chambers of counsel for the appellants/applicants. …
