Judgement

MONICA BOLNA'AN DONGBAN-MENSEM, J.C.A. (Delivering the Leading Judgment): The Hon. Justice Mobolajo A. Ojo (J) of the Ogun State High Court of Justice, Ota judicial division convicted and sentenced the Appellant for the offence of Robbery.

The Judgment was delivered on the 15th December, 2010. The offences for which the Appellant is convicted and sentenced are,

i. Conspiracy to commit Armed Robbery and,

ii. Armed Robbery

both contrary to and punishable under section 1 (2) (a) of the Robbery and Firearms (Special Provisions) Act, Laws of the Federation of Nigeria 2004.

The brief facts of the case before the trial court are; that on 1st May, 2008, the Appellant and two other persons accosted the PW1 who was travelling towards Sango in her Nissan Vanette bus with her aides. The incidence is alleged to have taken place at Idedo village along Owode/Idiroko Road, near Iju Town, Ogun State.
