MOORE ASEIMO ABRAHAM ADUMEIN, J.C.A. (Delivering the Leading Judgment): The appellant was the 3rd defendant in Charge No: MI/1818C/2012, where she and three other defendants were arraigned in the Chief Magistrate Court of Oyo State, holden at Ibadan charged with the following offences:

“COUNT I:- That you Lawal Akeem ‘m’ (2) Olafisu Demilade ‘m’ (3) Adejobi Olufunmilola ‘f’ at Queen Idia Hall, University of Ibadan, in the Ibadan magisterial district did conspired together to commit felony to wit stealing and thereby committed an offence contrary to and punishable under Section 516 of Criminal Code Cap 38 Vol. 11 Laws of Oyo State of Nigeria 2000.

COUNT II:- That you Lawal Akeem ‘m’ (2) Olafisu Demilade ‘m’ (3) Adejobi Olufunmilola ‘f’ and (4) Adisa Ayobami ‘m’ and others at large on the same date, time and place, in the aforementioned magisterial district did steal one blackberry bold II with pin no. 2287abcc valued about N33,000.
