Judgement

KENNETH IKECHUKWU AMADI, J.C.A. (Delivering the Leading Judgment): This is an appeal against the judgment of the National Industrial Court delivered on 16th December, 2016 by M.N. Esowe J. sitting in Abuja Division.

The Appellant commenced suit at the lower Court on 28th November, 2013 and in paragraph 19 of its amended statement of facts claimed the following reliefs:-

(i) DECLARATION of the Honourable Court that the Claimant having been employed by the Defendant pursuant to letter of appointment referenced: NASS/SEN/LAIPF/402B, dated 6th June, 2012, remains an employee of the Defendant, having not received any communication determining her employment.

(ii) DECLARATION that the Claimant is entitled against the Defendant to continue to receive her salaries, promotions and every other entitlement as an employee of the Defendant until her employment is determined.

(iii) ORDER of the Honourable Court commanding the Defendant to release and pay to the Claimant all her salaries and entitlement…
