MASSOUD ABDULRAHMAN OREDOLA, JCA (Delivering the Leading Judgment): This is an appeal against the decision of the High Court of Imo State, sitting at Mgbidi (hereinafter referred to as the lower Court) in Suit No. HOU/46/2000 delivered on the 6th day of June, 2005 by Hon. Justice Nonyerem Okoronkwo, J.

The suit which gave rise to this appeal was brought by the plaintiff/respondent (hereinafter referred to as the respondent) against the defendant/appellant (hereinafter referred to as the appellant), wherein the respondent claimed against the appellant for the following reliefs:

(i) ₦10,000,000.00 general damages for false imprisonment from 8th 10th, July, 1999.

(ii) Injunction (a) restraining the defendant from further computation of interest on the plaintiffs Account No. A/20134 after December, 1999 AND OR

(b) Compelling the Defendant to waive any sums owing on the said Account as debt as the Defendant wilfully refused to implement the agreement reached between the plaintiff and the Defen…
