BOLOUKUROMO MOSES UGO, J.C.A. (Delivering the Leading Judgment): This appeal is against the judgment of the High Court of Lagos State, delivered by K. A. Jose J. on the 27th day of September,2012.
Before the High Court of Lagos State, the Late Professor Babatunde Fafunwa as 1st claimant and the present 1st respondent, Otunba Abdul Ganiyu Kolawole Onikoyi, as 2nd claimant in a representative capacity for themselves and on behalf of the Onikoyi Royal family of Imoba land, Lagos, claimed from Union Bank of Nigeria Plc as the only defendant the following reliefs:
(i) A declaration that the Defendant has wrongly debited the claimants' (Onikoyi Royal Family) account with the amounts of N65,000,000.00 (Sixty-Five Million Naira) and N200,000,000.00 (Two Hundred Million Naira)
(ii) Payment of the amounts the total sum of N265,000,000.00 (Two Hundred and Sixty-Five Million Naira)
(iii) 14.5% per annum on the N65,000,000.00 (Sixty-Five Million Naira) from 6th July 2009 until the judgment sum is paid…
