DEACON A. ONYENEHELI V. CENTRAL BANK OF NIGERIA

KEKERE-EKUN JCA (Delivering the Lead Ruling): The applicant herein filed an undated motion on notice on 16 June 2003 praying for the following relief: “An order extending the time within which the appellant/ applicant may appeal against the judgment of the High Court of Imo State delivered on 25 October 2002 in suit No. HOW/ 128/96”.

The application is supported by a 12 paragraph affidavit deposed to by the applicant himself, Deacon Aaron Onyeneheli.

Annexed to the affidavit are two exhibits marked A andrespectively. Exhibit A is the proposed notice and grounds of appeal, while exhibitis a certified true copy of the judgment sought to be appealed against. The applicant deposed to a further affidavit dated 11 March 2003 containing 11 paragraphs in support of the application with one exhibit annexed thereto and marked exhibit A.
