This is an appeal launched by the 1st Defendant/Appellant (hereinafter referred to as Defendant) against the judgement of the High Court, Koforidua dated the 22nd day of November 2011, in favour of the Plaintiff/Respondent (hereinafter referred to as the Plaintiff).
The facts on which rests this appeal are simple and same can be summed up as follows:
The Plaintiff instituted an action in the Registry of the High Court, Koforidua on the 3rd of August 2008 and claims the following reliefs from the 1st and 2nd Defendants.
(1) Declaration to all that piece or parcel of land situate and lying at Adamrobe near Aburi and bounded by the property of Atta Borquaye, Nana Tettey, the Annan Camp, the property of Odjobi Aduamoah family, and the Amoani Koto family.
(2) An order of cancellation of any statutory declaration made in favour of the 2nd Defendant concerning the land in dispute or any part thereof.
(3) Recovery of possession.
(4) General damages for trespass.
