STEPHEN JONAH ADAH, JCA (Delivering the Leading Judgment): This is an appeal against the decision of the High Court of Justice of the Federal Capital Territory, Abuja, in Suit No: FCT/HC/CV/1156/2007, delivered on the 10th day of December 2009, Coram: S.C. Orji, J.

The 1st Respondent in this appeal was the Plaintiff while the Appellant was the 4th Defendant at the trial court. The reliefs claimed at the lower court by the Plaintiff now the 1st Respondent are as per the amended Writ and the Statement of Claim in the following:

1. A Declaration that the quit Notice dated 3rd July 2007 issued by the 2nd Defendant to the plaintiff in respect of property No. 106, 11 Crescent, Kado Abuja is null and void.

2. A Declaration that the plaintiff having fully paid for the property known as No. 106,11 Crescent Kado, Abuja, the 1st to 3rd Defendants seizes to have any property right in respect of same.

3. A Declaration that the plaintiff is the rightful owner of the property known as NO 106,11 Cresce…
