CHINWE EUGENIA IYIZOBA, J.C.A. (Delivering the Leading Judgment): The Appellant, TAMBAYA ORI was arraigned before the High Court of Ogun State sitting at Abeokuta on a three count charge of conspiracy to commit Armed Robbery contrary to Section 6(b) and Armed Robbery contrary to Section 2(2) (a) of the Robbery and Firearms (Special Provisions) Act (Cap R11) Laws of the Federation of Nigeria, 2004. The particulars of count 1 is that the Appellant along with others now at large on or about the 16th day of August, 2007 along Iwofin/Ayetoro road in the Abeokuta Judicial Division in the High Court of Ogun State, conspired to commit Armed Robbery.
