Judgement

SALAMI JCA (Delivering the Lead Ruling): This is an application brought by the applicants praying for-

“An order admitting the accused persons to bail upon such terms and conditions as this honourable court may deem fit to impose pending the determination of their appeal against the decision of the Federal High Court, Lagos delivered by T. Abubakar J on 13th March, 2007 in charge No. FHC/L/45C/2007, between Federal Republic of Nigeria v. Theodore Ahamaefule Orji and 4 Others .” It is supported by affidavit to which is exhibited the charge of 100 counts, a motion on notice asking the court below to quash all the 100 counts, summons for bail, ruling on application to quash the counts, notice of appeal dated 26th March, 2007, signed by solicitor; joint criminal form 1, dated 25th April, 2007; ruling on the summons for bail and medical reports, etc. There is a further affidavit deposed to on 9th May, 2007 and a further affidavit styled reply to counter-affidavit to motion for bail date…
