Judgement

MOORE ASEIMO ABRAHAM ADUMEIN, J.C.A. (Delivering the Leading Judgment): The respondents were the claimants in Suit No. B/520/3013 instituted in the High Court of Edo State, holden at Benin City. In the said suit, the respondent sought the following reliefs against the appellant, who was the defendant in the lower Court:

1. A declaration that the 2nd and 3rd Claimants are the majority shareholders and are capable of taking decisions for and on behalf of the shareholders.

2. A declaration that the acts of the Defendant or his agent withdrawing monies from the 1st claimants account for their personal use amounts to miss-appropriation or the 1st claimants money.

3. An order directing the Defendant to hand over the vehicles, incorporation certificate and other relevant documents belonging to the 1st Claimant to the 3rd Claimants or his agent.

4. An order directing the defendant to return the Renault bus, Alpha Romeo Truck, V/W Transporter and Chrysler Car to the Claimants.
