Judgement

UGOCHUKWU ANTHONY OGAKWU, J.C.A. (Delivering the Leading Judgment): The Appellant and six other persons were arraigned before the High Court of Lagos State in CHARGE NO. ID/160c/2011 on several counts of stealing, conspiracy and receiving stolen property. The Appellant took an objection to the Information preferred against him at the lower Court on several grounds and he urged the lower Court to quash the said information. The lower Court in its Ruling delivered on 23rd January 2012 dismissed the Appellants application. The Appellant was dissatisfied with the decision of the lower Court hence this appeal.

Before proceeding any further let me at this outset state that one of the defendants charged along with the Appellant herein at the lower Court was one Sebastian Adigwe. The said Sebastian Adigwe had equally objected to the Information preferred against him. The said objection is in pari materia with the Appellants objection that resulted in this appeal.
