ABDUL-AZEEZ WAZIRI, J.C.A. (Delivering the Leading Judgment): At the High Court of Abeokuta Judicial division Ogun State, the Appellant and his co-accused were charged on a two count information dated 9th day of June, 2015.

For ease of reference, the two count charge are herein under reproduced.

COUNT ONE: -

STATEMENT OF OFFENCE

Conspiracy to commit a felony to wit: obtaining money by false pretence contrary to Section 516 of the Criminal Code Law, Laws of Ogun State of Nigeria.

PARTICULARS OF OFFENCE

FATAI AKINWANDE (M), AKANNI SOTAYO (M), TAIWO OWODUNNI (M) and others still at large on or between March and June, 2011 at Isale Ijeun, Abeokuta in the Abeokuta Judicial division conspired to commit a felony to wit: obtaining money by false pretence.

COUNT TWO: -

STATEMENT OF OFFENCE

OBTAINING MONEY BY FALSE PRETENCE, CONTRARY TO AND PUNISHABLE UNDER Section 419 of the Criminal Code Law, Laws of Ogun State of Nigeria, 2006.
