GARBA JCA (Delivering the Lead Judgment): This is an appeal from the decision of the Imo State High Court sitting at Nkwerre delivered on 1 April 1998 in suit. No. HOR/148/88. The respondent as plaintiff had taken out a writ of summons and later filed a statement of claim against the appellant in the suit claiming as follows:-
