EJEMBI EKO, J.C.A. (Delivering the Leading Judgment): On 29th July, 2003 Sotonye Denton West, J (as she then was ) of the High Court of Rivers State made orders inter alia dismissing the Suit No. PHC/1812/2001 which was on the cause list until that day.

The plaintiffs in the suit, now Appellants, had claimed against the Defendants/Respondents, amongst others, a declaration that the 1st plaintiff/Appellant having been duly nominated, appointed and/or selected by the Elders, Warisenianu, men, women and youths of his community on 26th March, 2000, was the rightful occupant of the pollyn House Chieftaincy stool, Kalabibiama, Bonny, Rivers state and therefore entitled to all rights and privileges of the stool. They sought other declaratory reliefs. They also sought inter alia an order of perpetual injunction restraining the 1st Defendant/Respondent from parading himself in any manner whatsoever as the chief elect or occupant of the Pollyn Family stool.
