Judgement

JUDGEMENT 

Plaintiff is an employee at Defendant’s, the latter being a tertiary institution in  Ghana. Plaintiff by writ of summons and statement of claim sought the following  reliefs: 

i. A declaration that the positive acts of holding out Plaintiff as Deputy Rector  by the Defendant after the coming into force of the 2015 Statutes amounts  to appointing the Plaintiff under the 2015 Statutes. 

ii. A declaration that on a true and proper interpretation of the Ghana  Institute of Management and Public Administration (GIMPA) Statutes in  force for the time being, particularly Statutes 3, 4 and 15 thereof, the Plaintiff’s appointment as Deputy Rector of GIMPA is for a period of three  years. 

iii. A declaration that the attempts by the Defendant to appoint a Deputy  Rector for GIMPA whilst the Plaintiff’s term of office as Deputy Rector has  not expired are premature and unlawful.
