Judgement

AGUBE JCA (Delivering the Lead Judgment): In the Governorship and Legislative Houses Election Tribunal, holden at Ilorin, the petitioners (now appellants) sought for the following reliefs: “(a) That it may be determined that the Senatorial election held on 21 April 2007 in Kwara State South Senatorial District and the return of the 4th respondent thereof were void on the footing of wrongful exclusion of your petitioners from the said election by the 1st respondent. “(b) That the Senatorial election held on 21 April 2007 by the 1st respondent in Kwara South Senatorial District is null and void not having been held within the time stipulated by the Electoral Act, 2006. “(c) That the votes for which the 4th respondent was returned as elected Senator representing Kwara South Senatorial District on the platform of the 3rd respondent are unlawful and therefore null and void.

“(d) Order of the election petition tribunal ordering a by-election in Kwara South Senatorial District.”
