Judgement

OGUNBIYI JCA (Delivering the Lead Ruling): The motion on notice is brought pursuant to section 15 of the Court of Appeal Act, Cap. C36 Laws of the Federation of Nigeria, 2004; Order 1, rule 19(7), Court of Appeal Rules, 2002 and under the inherent jurisdiction of the court and seeks for the following prayers:-

“1. An order of injunction restraining the defendant/respondent and 3rd party/respondent whether by themselves, their heirs, agents or privies from selling or leasing the appellant/applicant’s property situate at No. 2, Bourdillon Road, Ikoyi, Lagos or in any manner attempting to sell, lease or dispose of the said property or in anyway interfering with the appellant/applicant’s rights and interests over the said property, pending the determination of the appeal filed against the judgment of Honourable Justice A. A. Phillips of the Lagos High Court, Lagos Judicial Division of 5th October, 2005 in this suit.
2. And for further or other orders as this honourable court may deem fit…
