BACKGROUND FACTS

This is an appeal against the Ruling of the High Court, Koforidua, dismissing the applicants/appellants motion for attachment of the respondents for contempt. The Ruling was delivered on 7th February 2006.

In this appeal, the applicant/appellants will be referred to simply as the appellants, and the respondents/ respondents as the respondents.

The facts of the case as gleaned from the record of appeal are that a dispute between the Asenie and Aduana families of Ntronang in the Akim Kotoku Traditional Area as to which of the two families had the right to put someone on the stool as Odikro of Ntronang was adjudicated upon by the Judicial Committee of the Akim Kotoku Traditional Council. [Hereinafter referred to as the Traditional Council]

The parties in that Suit were Opanin Yaw Krah and another (since deceased and substituted by the two appellants herein) as plaintiffs representing the Asenie family, and Baffour Yamoah Ponkoh [the 1st Respondent hereiā€¦
