The Applicant by this Application seeks from this Court an order committing the Respondent to prison for contempt of Court. 

The facts upon which this application is premised are evident from the affidavit and supplementary affidavit of the Applicant deposed to by her Attorney. The Applicant states that she issued a Writ of Summons,  Statement of Claim and Motion on Notice for an order of interlocutory injunction on 22nd April 2015. The application for injunction which sought to restrain the Respondent, her agents, servants among others from interfering with the Plaintiff’s possession of the land in dispute and from  developing same until the final determination of the suit, was served on the  Respondent. 

According to the Applicant, at the time of service of the Writ of Summons and Statement of claim, the Respondent had excavated the land and constructed a foundation as per Exhibits CML 13 – CML 18, and as at 4th May 2015 when the Respondent filed an affidavit in opp…
