This appeal is against the ruling of the High Court, Kumasi dated 5th March 2008. The background to the application is as follows:

The Applicants who were part-time students of the Law faculty of the Kwame Nkrumah University of Science and Technology were dismissed in the 2nd Semester of the 2006/2007 academic year on allegation of their involvement in examination malpractices in the Commercial Law paper II. The Respondent set up a Committee to investigate the matter.

The Applicants on two previous occasions raised objections against officers who were appointed as Chairmen of the Committee. The objections were upheld and the Committee was reconstituted twice with a different Chairman. On 29th October 2007, a third objection was raised by Counsel for the Applicant.

This is where there is a disparity between the parties as to the reasons that was assigned to the objection. Whereas the Applicants alleged that the objection was against the composition of the panel…
