This appeal emanates from the ruling of the High Court, Fast Track Division, Kumasi dated 23rd February, 2005. In the said ruling, the trial court found the 1st, 2nd and 3rd respondents, now appellants, liable for contempt of court and sentenced each of them to a fine of ¢2,000,000.00 or in default to serve three months imprisonment.

The facts of the case, as gathered from the affidavits filed by the parties, are that by the demise of Nana Kwaku Affum, the Akwamuhene of Agogo Traditional Area in/or about April, 2003, the Akwamu Stool which is occupied by a member from the Asakyiri Royal Family became vacant. It therefore became necessary to find a successor to occupy the stool. The applicant, in his capacity as the head of the said royal family and also a Kingmaker, nominated Nana Adu Asabere whilst the 2nd respondent nominated Opanin Kwame Boamah who is the 1st respondent.
