S U M M A R Y J U D G M E N T
On 26th June, 2019, the Plaintiff mounted the instant action against the Defendant for the following reliefs as endorsed on the writ of summons and statement of claim:
a. Recovery of total sum of One Hundred and Ten Thousand Cedis (GH¢110,000.00) being money paid for four (4) plots of land which Defendant failed to provide.
b. Interest on the said amount at the prevailing bank rate from 7th June, 2018 to date of final payment.
c. Costs.
The gravamen of the Plaintiff’s claim is contained in paragraphs 3 to 11 of the statement of claim, a summation of which is as follows:
According to the Plaintiff, sometime in the early part of 2017, the Defendant approached him with a claim that he had four (4) plots of land for sale. That he informed the Defendant at the time that he was not financially sound to purchase the said plots of land. According to the Plaintiff, the Defendant proposed installment payments to him, which offer he accepted.
